TRIO OF DWI INVESTIGATIONS LEADS TO 4 ARRESTS, 2 DAMAGED POLICE CARS, AND ONE INJURED POLICE OFFICER




The West Seneca Police Department had a busy few nights over the last weekend. Beginning on 2/16/2017 at approximately 9:30 pm, patrol officers observed a vehicle traveling west on East & West Rd without their headlights on. Patrol conducted a traffic stop in the 900 block of Union Rd. Patrol detected a strong odor of alcohol and the driver having glassy eyes. Officers conducted field sobriety tests and after completing their investigation, arrested Dorothy Mix of West Seneca for DWI. Mix was returned to the station where she gave a breath test sample of .17%. Mix was booked, processed, and released to a sober adult. She is due back in West Seneca Court at a later date.

During the aforementioned DWI investigation, officers were stunned when they heard squealing tires behind them, and looked to see a car skidding towards them. Luckily, officers were two cars ahead when the vehicle crashed into the rear end of one of the West Seneca Police SUVs on the scene. The police SUV sustained heavy rear end damage, where officers just moments before, had been in the trunk of that vehicle obtaining equipment for their investigation. Upon investigation of the crash, the officers noted that the driver smelled of an alcohol beverage and had glassy eyes. The driver also admitted to having his “fair share” of beers. The driver was evaluated by paramedics and refused further care. Officers conducted filed sobriety tests and after completing their investigation arrested Scott J. Miller of West Seneca for DWI. Miller was returned to the station where he gave a breath test sample of .14%. Miller was charged with DWI, Speeding, and violating the “Move Over Law”, which is designed to protect officers during traffic stops. Miller was booked, processed, and released to a sober adult. He is due back in West Seneca Court at a later date.

On 2/18/2017 at approximately 4:00 am, patrol officers stopped a vehicle for speeding on Seneca St. in West Seneca. The vehicle was observed to be traveling 62 mph in a posted 35 mph zone. Upon speaking with the driver, patrols noted the driver to have blood shot eyes, slurred speech, and the odor of an alcohol beverage. Officers conducted field sobriety tests and after completing their investigation, arrested Eric J. Luman of West Seneca for DWI.

During the arrest of Luman, a passenger in the vehicle became disorderly with officers after being advised that her vehicle was being impounded according to the law. After multiple warnings to cease her disorderly ways, officers arrested Brittany N. Arvello of West Seneca for Disorderly Conduct. Arvello was returned to the station where she was booked, processed, and released to a sober adult. She is due back in West Seneca Court at a later date.

During the subsequent arrest of Arvello, the original arrestee Luman, became irate and attempted to smash the window out of the patrol vehicle that he was in, causing minor damage. Patrols were forced to struggle with him and secure him in leg restraints. During the struggle, one of the officers sustained a cut to his face, but remained on duty. Luman was returned to the station where he refused a breath test. Luman was booked, processed, and released to a sober adult. Luman was charged with DWI, Aggravated Unlicensed Operation 1st degree (E Felony), Speeding, Obstruction 2nd degree (A Misdemeanor), Attempted Criminal Mischief 4th degree (B Misdemeanor), and Attempted Assault on a Police Officer 2nd degree (E Felony). He is due back in West Seneca Court at a later date.
