PAIR OF DWI ARRESTS OVERNIGHT.



Erie County Sheriff Timothy B. Howard reports Deputies made separate arrests last night following traffic investigations. March 14, 9:07 P.M.*, Town of Elma – Deputies Tyczka and Zamorek were dispatched to the southbound stretch of Route 400 near Porterville Road for a report of a vehicle off the roadway. When the Deputies arrived, they observed a vehicle approximately 30 feet off the roadway resting in a ditch and a male in the driver’s seat. While speaking with the operator, he volunteered the fact that he had been drinking at a function. Standard field sobriety tests were administered followed by a breath test. The deputies charged Tyler Lewis, 22 of East Aurora, with DWI – first offense, operating a vehicle with a BAC level higher than .08%, and a vehicle and traffic law violation. The defendant was released to a sober third party. *East Aurora Police Department assisted with the incident. March 15, 12:33 A.M., Town of Elma – Deputy Zamorek initiated a traffic stop on Clinton Street for vehicle and traffic law violations. During his investigation, the Deputy observed signs of impairment and Deputy Biegasiewicz, a Drug Recognition Expert, conducted a DRE evaluation which resulted in a result of impairment. Deputies also discovered a quantity of concentrated cannabis and Xanax. Kevin Kaiser, 28 of Orchard Park, was arrested and charged with DWI – first offense, DWI – impaired by drugs, DWAI – combined influence of drugs or alcohol, two counts of criminal possession of a controlled substance, criminal possession of marijuana – more than 25 grams, unlawful possession of marijuana, and two vehicle and traffic violations. The defendant was later released.
