LEANDRA'S LAW AND AGGRAVATED DWI ARRESTS MADE 12 HOURS APART



Erie County Sheriff Timothy B. Howard reports Deputies made two separate Aggravated DWI arrests in a twelve hour period starting Thursday afternoon. The first arrest occurred Thursday, June 1, on West River Road in the Town of Grand Island. At approximately 1:30 P.M. Detective O’Hara stopped a vehicle after he observed it cross the center line and nearly strike an oncoming vehicle. The Detective detected the strong odor of alcohol and the operator displayed signs of intoxication. Deputy T. Was arrived and continued the investigation. Christina Doan, 34 of Tonawanda, failed field sobriety tests and was transported to the Grand Island Substation of further testing. A breath test indicated Doan had a BAC level more than four times the legal limit. Doan was arrested and charged with a felony count of Aggravated DWI (BAC .18 or higher), a felony count of Leandra’s Law, a misdemeanor count of Endangering the Welfare of a Child, and two vehicle and traffic violations. Doan’s 4-year-old daughter was turned over to a family member, and the defendant was taken to the Erie County Medical Center for evaluation and treatment. Then, on June 2, at 1:48 A.M. Deputy Arney stopped an eastbound vehicle on Main Street in the Town of Newstead for traveling 103 MPH in a 55 MPH zone. Jonathan Donnelly, 30 of Akron, failed numerous field sobriety tests and registered a BAC level of nearly four times the legal limit. Donnelly is charged with Aggravated DWI, a misdemeanor count of reckless driving, and speeding. The defendant was issued a notice to appear and later released to a family member.
