DRIVER FACES FOURTH DWI CONVICTION AFTER CRASH.

The West Seneca Police Department announces the arrest of Thomas A. Capitano 4/20/1986 of Lein Rd, West Seneca, NY. On 12/14/2017 at 7:12 pm, patrols responded to a reported car crash on Seneca St, in which a pickup truck operated by Capitano struck a parked vehicle and was attempting to flee. When officers arrived on scene they quickly determined that Capitano was under the influence of an intoxicant. Capitano failed field sobriety tests and was taken into custody under suspicion of driving under the influence of drugs. A certified drug recognition expert was requested to perform an evaluation, which deemed Capitano to be under the influence of a depressant and that he was unable to safely operate a motor vehicle. Capitano was returned to WSPD headquarters where he was booked into jail. Capitano was charged with the following: • DWI- Drugs (class D Felony due to his 3 previous convictions within the past 8 years) • Aggravated Unlicensed Operation 1st Degree (Class E Felony due to previous DWI Convictions) • Aggravated Unlicensed Operation 2nd Degree (Unclassified Misdemeanor due to Alcohol related offenses) • Aggravated Unlicensed Operation 2nd Degree (Unclassified Misdemeanor due to 10 license revocations and / or suspensions) • Circumventing an Ignition Interlock Device • Failure to maintain lane, and other various traffic related offenses Capitano was arraigned before Judge Harrington and was remanded to the Erie County Holding Center without bail to await his next court appearance.
