On April 25, 2021, at approximately 1:30 a.m., State Police stopped a vehicle on State Route 198 in the city of Buffalo for a vehicle and traffic violation. The driver of the vehicle, Larry C. Graham, 38, of Buffalo, NY, was found to be intoxicated. During a vehicle inventory, Troopers located a loaded Smith and Wesson SW9VE 9MM pistol. Further investigation revealed the magazine was loaded with 15 rounds along with one round in the chamber.
Graham did not possess a New York State Pistol permit. He was taken into custody, transported, and processed at SP Buffalo where his blood alcohol content was determined to be .14%.
Graham was charged with Criminal Possession of a Weapon 2nd degree; a Class C Felony, Criminal Possession of a Weapon 3rd degree; a Class D Felony and Driving While Intoxicated; an Unclassified Misdemeanor. He was virtually arraigned before the City of Albany Court and was released on his own recognizance.
Graham was turned over to a sober third party and is scheduled to reappear in the City of Buffalo Court on June 9, 2021 at 9:30 a.m.
